Picobi Terms of Service

These Terms of Service (“Terms”) govern the relationship between JellybeanGames (“Company,” “we,” “us,” or “our”) and users in connection with the mobile game Picobi and related services (collectively, the “Service”).
By expressly accepting these Terms and using the Service, you agree to be bound by them.
Any notice or consent separately required by applicable law will be handled through a separate process where necessary.
We may amend these Terms where reasonably necessary due to changes in the Service, applicable laws or policies, security, technical requirements, or legitimate business needs.
Material changes will be communicated in advance where required by applicable law. Where renewed consent is legally required, we will request it separately.
If you do not agree to amended Terms, you may discontinue use of the Service and request account deletion.
Picobi may support anonymous accounts and authentication or account linking through providers such as Google and Apple.
An anonymous account that has not been linked may be difficult or impossible to recover after deleting the app, resetting or changing a device, or losing local account information.
You are responsible for reasonably safeguarding your account and authentication methods. Accounts may not be sold, transferred, rented, shared, or otherwise provided to third parties unless expressly permitted by the Company.
Where required by applicable law, minors must obtain consent from a parent or legal guardian before using the Service or purchasing paid content.
Nothing in these Terms limits any mandatory rights available to minors or their legal representatives.
Picobi may provide avatar customization, virtual items and currencies, randomized content, mini-games, rewarded advertising, in-app purchases, image or content features, game-data storage, events, and other functionality.
We may reasonably add, modify, rebalance, restrict, or discontinue features or content for operation, game balance, security, technical requirements, changing user environments, or legitimate business needs.
This may include changes to virtual-item designs or characteristics, methods of acquisition, costs, rewards, events, and game balance.
Mandatory rights relating to completed purchases remain unaffected.
Candy, Jelly, virtual items, and similar content are digital rights intended for use within Picobi. Unless applicable law provides otherwise, they are not cash, deposits, financial assets, or real-world currency.
Users may not sell, exchange, or trade accounts, virtual currency, or virtual items for money or economic benefit unless expressly permitted by the Company.
We may reasonably correct or remove currency or items obtained through technical error, duplicate grants, fraud, abuse, or other improper circumstances.
Picobi may include gacha or other randomized content.
Where required by law or platform rules, the Company will disclose applicable probability information through the Service or another appropriate method.
No particular outcome is guaranteed.
A properly completed draw cannot generally be reversed or redrawn solely because the user did not receive the desired result, except where applicable law provides otherwise.
Paid content may be purchased through marketplaces such as Apple App Store or Google Play.
Applicable marketplace payment terms may also apply.
The Company may process transaction information necessary to verify purchases, deliver content, prevent duplicate grants, process refunds, and prevent fraudulent payments.
When a valid payment is refunded or reversed, the Company may remove the virtual currency, items, or benefits granted by that transaction.
Refunds, withdrawal rights, payment corrections, and cancellations are governed by mandatory applicable law and the rules of the relevant marketplace.
Where legally permitted, withdrawal rights for digital content may be restricted after the content has been supplied or consumed.
Nothing in these Terms excludes any non-waivable consumer right.
The Service may display advertisements provided by the Company or third parties.
Rewarded advertising benefits are provided when the applicable completion and verification conditions are satisfied.
Network errors, advertising-provider failures, or other technical problems may delay verification or reward delivery.
Fraudulent, automated, manipulated, or abusive use of advertising or reward systems is prohibited.
You retain ownership of content you lawfully upload or provide.
You authorize the Company to store, reproduce, technically transform, display, transmit, back up, and otherwise process such content only as reasonably necessary to provide and operate the Service and the features you request.
You must have the legal right to provide any content you upload.
The Company may restrict or remove content that violates law, third-party rights, or materially threatens the safety or normal operation of the Service.
All intellectual property rights in Picobi, including software, characters, artwork, user interfaces, music, names, logos, virtual items, and Company-created content, are owned by or lawfully licensed to JellybeanGames.
Users may use such content only as permitted within the Service.
Unauthorized reproduction, sale, commercial exploitation, modification, distribution, or infringement is prohibited.
Users must not engage in conduct including:
-  violations of law or these Terms; 
-  cheats, hacks, app or memory modification, or unauthorized clients; 
-  intentional exploitation of bugs or vulnerabilities; 
-  bots, macros, or automation that interferes with normal use; 
-  abnormal load or interference with the Service; 
-  unauthorized trading of accounts, currency, or items; 
-  abuse of purchases, refunds, advertisements, rewards, events, or promotions; 
-  infringement of privacy, intellectual property, or other rights; 
-  impersonation; 
-  unlawful circumvention of security protections; or 
-  use of the Service for illegal purposes. 
Where a user violates these Terms or materially threatens the fairness, security, or integrity of the Service, the Company may take proportionate measures including warnings, feature restrictions, correction or removal of improperly obtained benefits, temporary suspension, or account termination.
Urgent protective action may be taken first where necessary to prevent fraud, security incidents, or further harm.
The Company may temporarily suspend the Service because of maintenance, system or network failures, security incidents, force majeure, legal requirements, or circumstances outside its reasonable control.
The Company may discontinue all or part of the Service for legitimate business reasons, subject to any notice or user-protection requirements imposed by applicable law.
The Company uses reasonable efforts to provide a stable Service, but does not guarantee uninterrupted or error-free operation on every device or any particular outcome except where required by law.
The Company is not responsible for losses caused by the user's fault, force majeure, device or network problems, marketplace failures, or third-party services outside the Company's reasonable control, except where the Company is legally responsible.
Nothing in these Terms excludes liability for intentional misconduct, gross negligence, or any liability that cannot lawfully be excluded.
Mandatory consumer rights remain unaffected.
Personal data is processed in accordance with the Picobi Privacy Policy and applicable law.
The Privacy Policy is available through the Service or another publicly accessible channel.
Users may request account deletion through available in-app functionality or customer support.
After deletion, account and gameplay data may become permanently unrecoverable, except for information that must or may lawfully be retained for transactions, legal obligations, disputes, security, or fraud prevention.
These Terms are governed by the laws of the Republic of Korea, without prejudice to mandatory consumer protections applicable in the user's country or region.
The Company and users will attempt in good faith to resolve disputes amicably. Unresolved disputes may be submitted to a court with jurisdiction under applicable law.

본 이용약관(이하 “본 약관”)은 JellybeanGames(이하 “회사”)가 제공하는 모바일 게임 Picobi 및 이에 부수되는 서비스(이하 통칭하여 “서비스”)의 이용과 관련하여 회사와 이용자 사이의 권리, 의무, 책임 및 기타 필요한 사항을 정하는 것을 목적으로 합니다.
이용자는 본 약관에 동의한 후 서비스를 이용할 수 있습니다. 법령상 별도의 동의 또는 고지가 필요한 사항은 본 약관과 별도로 처리될 수 있습니다.
1.  본 약관은 서비스 내 화면, 연결된 웹페이지 또는 기타 적절한 방법으로 이용자에게 제공됩니다. 
2.  이용자가 본 약관에 동의하고 서비스를 이용하는 경우 본 약관이 적용됩니다. 
3.  회사는 관계 법령을 위반하지 않는 범위에서 서비스 운영, 법령이나 정책의 변경, 기술적·사업적 필요 등을 이유로 본 약관을 변경할 수 있습니다. 
4.  이용자에게 중대한 영향을 미치는 변경은 관계 법령에서 요구하는 방법과 기간에 따라 사전에 고지합니다. 
5.  법령상 별도의 동의가 필요한 변경에는 필요한 동의 절차를 진행합니다. 
6.  변경된 약관에 동의하지 않는 이용자는 서비스 이용을 중단하고 계정 삭제 등 이용계약 종료를 요청할 수 있습니다. 
1.  Picobi는 익명 계정 또는 회사가 지원하는 Google, Apple 등의 인증 수단을 통해 이용할 수 있습니다. 
2.  익명 계정을 외부 인증수단과 연결하지 않은 경우 앱 삭제, 기기 초기화, 기기 변경 등으로 계정이나 게임 데이터 복구가 제한되거나 불가능할 수 있습니다. 
3.  이용자는 자신의 계정과 인증수단을 안전하게 관리하여야 하며, 회사가 명시적으로 허용한 경우를 제외하고 계정을 제3자에게 판매, 양도, 대여, 공유하거나 기타 방식으로 제공해서는 안 됩니다.
4.  회사는 계정 보안, 부정 이용 방지 및 서비스 보호를 위해 필요한 범위에서 이용자 확인 또는 추가적인 보안 절차를 적용할 수 있습니다. 
5.  이용자의 고의 또는 과실로 계정이나 인증정보가 제3자에게 노출되어 발생한 손해에 대해서는 회사의 고의 또는 중대한 과실이 없는 한 회사가 책임을 부담하지 않습니다. 
1.  미성년자는 관계 법령상 필요한 경우 법정대리인의 동의를 받아 서비스를 이용하거나 유료 콘텐츠를 구매하여야 합니다. 
2.  미성년자 또는 법정대리인에게 관계 법령상 취소권, 청약철회권 또는 기타 권리가 인정되는 경우 본 약관은 그러한 권리를 제한하지 않습니다. 
3.  아동 또는 미성년자의 개인정보 처리에 별도의 법정대리인 동의가 필요한 경우 회사는 관계 법령에 따라 필요한 절차를 적용할 수 있습니다. 
1.  회사는 Picobi에서 캐릭터 및 아바타 꾸미기, 게임 아이템, 가상재화, 가챠 등 확률형 콘텐츠, 미니게임, 광고 보상, 인앱 구매, 이미지 및 콘텐츠 관련 기능, 게임 데이터 저장 및 기타 부가 기능을 제공할 수 있습니다. 
2.  구체적인 서비스 내용과 이용방법은 게임 내 안내에 따릅니다. 
3.  회사는 서비스 운영, 게임 밸런스, 보안, 기술적 필요, 이용환경 변화 또는 사업상 합리적인 필요가 있는 경우 서비스의 기능이나 콘텐츠를 추가, 변경, 조정 또는 종료할 수 있습니다. 
4.  전항에는 아이템의 구성·디자인·효과·획득방법, 게임 내 재화의 소모량, 보상, 이벤트 및 게임 밸런스의 변경 등이 포함될 수 있습니다. 
5.  이용자의 유료 구매나 기타 법적으로 보호되는 권리에 중대한 영향을 미치는 사항은 관계 법령에 따라 처리합니다. 
1.  서비스에서는 Candy, Jelly 등 가상재화와 각종 게임 아이템을 사용할 수 있습니다. 
2.  가상재화와 게임 아이템은 Picobi 서비스 내에서 사용할 수 있는 디지털 콘텐츠 또는 이용권적 성격을 가지며, 관계 법령에서 달리 정하는 경우를 제외하고 현금, 예금, 금융자산 또는 현실의 재산적 권리를 의미하지 않습니다. 
3.  이용자는 회사가 명시적으로 허용한 경우를 제외하고 계정, 가상재화 또는 게임 아이템을 현금이나 기타 경제적 이익과 교환·판매·거래할 수 없습니다. 
4.  회사는 오류, 중복 지급, 부정 이용, 시스템 장애 기타 정당한 사유로 잘못 지급되거나 부당하게 취득된 재화나 아이템을 합리적인 범위에서 정정 또는 회수할 수 있습니다. 
5.  정상적으로 구매한 유료 콘텐츠에 관한 이용자의 권리는 관계 법령에 따라 보호됩니다. 
1.  서비스에는 결과가 일정한 확률에 따라 결정되는 가챠 등 확률형 콘텐츠가 포함될 수 있습니다. 
2.  회사는 관계 법령과 앱마켓 정책에서 요구하는 경우 확률형 아이템의 종류와 공급확률 등 필요한 정보를 게임 내 또는 기타 적절한 방법으로 제공합니다. 
3.  확률형 콘텐츠는 특정 결과의 획득을 보장하지 않습니다. 
4.  정상적으로 처리된 결과는 단순 변심이나 원하는 결과를 획득하지 못했다는 이유만으로 취소하거나 재추첨할 수 없습니다. 다만 관계 법령에서 달리 정하는 경우에는 그러하지 않습니다. 
5.  서버 또는 시스템 오류가 확인되는 경우 회사는 관련 기록을 확인하여 복구, 재지급 또는 기타 합리적인 조치를 할 수 있습니다. 
1.  유료 콘텐츠의 결제는 Apple App Store, Google Play 등 이용자가 이용하는 앱마켓의 결제 시스템을 통해 이루어질 수 있습니다. 
2.  결제에는 해당 앱마켓의 약관과 결제정책이 함께 적용될 수 있습니다. 
3.  회사는 정상적인 구매 확인, 콘텐츠 지급, 중복 지급 방지, 환불 및 부정 결제 대응을 위해 필요한 거래정보를 확인할 수 있습니다. 
4.  정상적으로 환불 또는 결제취소된 거래의 경우 회사는 해당 거래를 통해 지급된 가상재화, 아이템 또는 이에 상응하는 혜택을 회수할 수 있습니다. 
5.  환불·chargeback·결제 시스템을 부정하게 이용하는 경우 회사는 사실관계를 확인한 후 해당 거래 또는 계정에 필요한 조치를 취할 수 있습니다. 
1.  유료 콘텐츠의 청약철회, 환불, 과오금 및 결제취소는 이용자에게 적용되는 관계 법령과 해당 앱마켓의 정책에 따라 처리됩니다. 
2.  디지털 콘텐츠가 이미 제공되거나 사용된 경우 관계 법령이 허용하는 범위에서 청약철회가 제한될 수 있습니다. 
3.  중복 결제 또는 이용자의 책임 없는 과오금이 확인되는 경우 관계 법령에 따라 처리합니다. 
4.  본 약관은 강행법규에 의해 보장되는 소비자의 환불 또는 청약철회 권리를 제한하지 않습니다. 
1.  서비스에는 회사 또는 제3자가 제공하는 광고가 표시될 수 있습니다. 
2.  광고의 내용, 방식 및 제공 여부는 이용자의 국가·지역, 관련 개인정보 선택 및 서비스 운영환경 등에 따라 달라질 수 있습니다. 
3.  광고 보상은 회사 또는 광고 제공 시스템이 요구하는 시청·완료·검증 조건이 정상적으로 충족된 경우 지급됩니다. 
4.  네트워크 장애, 광고 제공자의 오류 기타 기술적인 사유로 완료 사실을 확인할 수 없는 경우 보상 지급이 지연될 수 있습니다. 
5.  회사는 서버나 광고 시스템의 객관적인 기록 등을 토대로 보상 여부를 확인하고 필요한 경우 합리적인 조치를 할 수 있습니다. 
6.  광고 또는 보상 시스템의 자동화, 조작, 반복적인 악용 등 부정한 이용은 금지됩니다. 
1.  이용자가 서비스에 이미지, 작성물 또는 기타 콘텐츠를 업로드하거나 저장하는 경우 해당 콘텐츠의 권리는 원칙적으로 이용자 또는 정당한 권리자에게 귀속됩니다. 
2.  이용자는 자신이 제공하는 콘텐츠를 서비스에서 사용할 적법한 권리를 보유하고 있어야 합니다. 
3.  이용자는 회사가 서비스를 제공·운영하고 이용자가 요청한 기능을 수행하기 위해 필요한 범위에서 해당 콘텐츠를 저장, 복제, 변환, 표시, 전송, 백업 및 기술적으로 처리할 수 있도록 허용합니다. 
4.  회사는 법령 또는 제3자의 권리를 침해하거나 서비스의 안전·정상 운영을 심각하게 저해하는 콘텐츠의 이용을 제한하거나 삭제할 수 있습니다. 
5.  본 조에 따라 이용자 콘텐츠의 소유권 자체가 회사로 이전되는 것은 아닙니다. 
Picobi의 프로그램, 캐릭터, 그래픽, UI, 음악, 명칭, 로고, 아이템 및 회사가 제작하거나 적법하게 이용하는 기타 콘텐츠의 지식재산권은 회사 또는 정당한 권리자에게 귀속됩니다.
이용자는 서비스가 허용하는 범위 내에서만 해당 콘텐츠를 이용할 수 있으며, 회사 또는 권리자의 허락 없이 이를 복제, 판매, 상업적으로 이용, 변조, 배포하거나 권리를 침해해서는 안 됩니다.
이용자는 다음 행위를 해서는 안 됩니다.
1.  법령 또는 본 약관을 위반하는 행위 
2.  해킹, 치팅, 앱·메모리·네트워크 데이터의 변조 또는 비공식 클라이언트 이용 
3.  버그, 오류 또는 보안 취약점을 고의로 악용하는 행위 
4.  봇, 매크로 또는 자동화 수단을 이용해 정상적인 서비스를 방해하는 행위 
5.  서버 또는 서비스에 비정상적인 부하를 발생시키는 행위 
6.  회사가 허용하지 않은 계정·아이템·가상재화의 판매 또는 거래 
7.  구매, 환불, 광고보상, 이벤트 또는 프로모션을 부정하게 이용하는 행위 
8.  타인의 개인정보·저작권·초상권 등 권리를 침해하는 행위 
9.  회사 또는 타인을 사칭하는 행위 
10.  보호수단을 우회하거나 서비스를 불법적인 목적으로 분석·변조하는 행위 
11.  범죄 또는 기타 위법행위에 서비스를 이용하는 행위 
12.  기타 서비스의 공정성, 안정성 또는 정상적인 운영을 중대하게 해치는 행위 
1.  이용자가 본 약관이나 법령을 위반한 경우 회사는 위반의 정도, 반복 여부 및 고의성 등을 고려하여 경고, 기능 제한, 잘못 취득한 재화나 콘텐츠의 정정·회수, 일시정지 또는 영구 이용제한 등의 조치를 취할 수 있습니다. 
2.  보안사고, 심각한 부정 이용 또는 피해확산의 우려가 있는 경우 회사는 서비스 보호를 위한 긴급조치를 먼저 취한 후 필요한 안내를 할 수 있습니다. 
3.  이용자는 고객지원 채널을 통해 이용제한에 대해 문의할 수 있습니다. 
1.  회사는 점검, 서버·네트워크 장애, 보안사고, 천재지변, 통신장애, 법령이나 정부기관의 요구, 기타 회사가 합리적으로 통제하기 어려운 사유가 있는 경우 서비스 전부 또는 일부를 일시 중단할 수 있습니다. 
2.  회사는 사업상 합리적인 사유가 있는 경우 서비스 전부 또는 일부를 종료할 수 있습니다. 
3.  이용자에게 중대한 영향을 미치는 서비스 종료의 경우 관계 법령에 따라 필요한 사전고지 및 이용자 보호조치를 시행합니다. 
4.  유료 콘텐츠 등에 관한 권리는 관계 법령에 따라 처리합니다. 
1.  회사는 서비스의 안정적인 제공을 위하여 합리적인 노력을 합니다. 
2.  다만 법령에서 달리 정하지 않는 한 회사는 서비스가 항상 중단 없이 제공되거나 모든 기기에서 오류 없이 동작하거나 이용자가 기대하는 특정 결과를 보장하지 않습니다. 
3.  이용자의 귀책사유, 불가항력, 통신망·기기·앱마켓 또는 회사가 합리적으로 통제할 수 없는 제3자 서비스로 인하여 발생한 손해에 대해서는 회사의 책임이 인정되는 경우를 제외하고 회사가 책임을 부담하지 않습니다. 
4.  회사의 책임이 인정되는 경우에도 관계 법령이 허용하는 범위에서 실제 발생하고 통상적으로 예견 가능한 직접손해를 기준으로 책임을 부담합니다. 
5.  회사의 고의 또는 중대한 과실 등 법률상 책임을 배제할 수 없는 경우에는 본 조의 제한이 적용되지 않습니다. 
6.  본 약관은 관계 법령이 이용자에게 보장하는 강행적인 소비자 권리를 제한하지 않습니다. 
회사는 서비스 제공 과정에서 개인정보를 Picobi 개인정보처리방침 및 관계 법령에 따라 처리합니다.
이용자는 서비스 설정 또는 회사가 제공하는 공개 경로를 통해 개인정보처리방침을 언제든 확인할 수 있습니다.
1.  이용자는 서비스에서 제공되는 계정 삭제 기능 또는 고객지원을 통해 계정 삭제를 요청할 수 있습니다. 
2.  계정 삭제가 완료되면 관계 법령상 보관이 필요한 정보를 제외한 계정 및 게임 데이터는 삭제 또는 비식별 처리될 수 있으며 복구가 불가능할 수 있습니다. 
3.  회사는 거래, 법적 의무, 분쟁 또는 부정 이용 대응 등을 위해 관계 법령에 따라 보관이 필요한 정보는 필요한 기간 동안 별도로 보관할 수 있습니다. 
1.  본 약관 및 서비스와 관련된 사항에는 대한민국 법률을 적용합니다. 
2.  다만 이용자의 거주 국가에서 강행적으로 적용되는 소비자보호법상 권리는 본 조로 제한되지 않습니다. 
3.  회사와 이용자는 분쟁이 발생할 경우 원만한 해결을 위해 노력하며, 해결되지 않는 경우 관계 법령에 따라 관할권이 인정되는 법원에서 해결합니다.
